Job Title: Assistant Corporation Counsel - Special Federal Litigation
Job Responsibilities:
The Assistant Corporation Counsel in the Special Federal Litigation Division of the Law Department is tasked with defending the City and its officials in civil rights cases filed in federal court. These cases often involve allegations of police, district attorney, or correction officer misconduct, particularly in scenarios where individuals claim their constitutional rights were violated during arrests, prosecutions, or within City jails. The responsibilities include:
- Defending the City and law enforcement members in cases where litigants have had convictions reversed.
- Handling cases challenging the constitutionality of police actions during demonstrations and the enforcement of cannabis laws.
- Engaging in class actions related to various constitutional claims.
- Managing a caseload from inception through resolution, utilizing motion practice, settlement, or trial.
- Conducting initial investigations to assess the appropriateness of representation.
- Answering complaints and appearing at court conferences.
- Engaging in extensive discovery, both paper and electronic.
- Taking and defending depositions.
- Drafting dispositive motions.
- Conducting settlement negotiations.
- Taking cases to trial in federal court when necessary.
Attorneys will have the option to work from home after completing orientation, under two programs: a limited and irregular remote work option, and a Citywide pilot program allowing two set days of remote work per week, subject to division approval and operational needs.
Education and Experience:
Applicants must possess a minimum of two years of litigation experience following graduation from an American Bar Association (ABA) accredited law school. Preference is given to those with experience in federal practice, municipal liability, constitutional, or personal injury law. Candidates must be admitted to practice law in the State of New York and either be admitted or eligible for immediate admission to the Southern District of New York (SDNY) and Eastern District of New York (EDNY). Strong legal writing and oral advocacy skills are essential.
Salary Information:
The salary range for the position is $87, – $175,.
